Terms of service
These Terms and Conditions (“Terms”) apply to all purchases made through Newbear’s online store (newbear.nl). Newbear, headquartered at Meent 93D, 3011JG Rotterdam, The Netherlands (hereafter “Newbear” or “we”) is the seller of designer clothing on the Shopify platform. We have no physical retail store – customer service is handled solely via email (service@newbear.nl). By placing an order, you (the “Customer”) agree to these Terms, which comply with Dutch and EU consumer laws. All product, price, shipping and payment information are made clear to you before purchase.

We will promptly send you an order confirmation by email after you complete your purchase. This email confirms the details of your order and the total price (including Dutch VAT and any shipping charges). All prices are in EUR and include Dutch VAT. Any additional costs (shipping, etc.) are stated up front.
Placing Orders & Contract Formation
Orders can be placed through our website. An order becomes binding when we send an order confirmation email (or ship the goods). Please review the confirmation carefully; if you notice any errors, notify us immediately. The contract is subject to availability of the goods and the accuracy of the information you provide (name, address, payment details, etc.). We reserve the right to refuse an order or cancel it if payment cannot be processed or if we suspect fraud.
Payment
Payment is due at the time of ordering. We accept the following payment methods:

No extra fees are added for using these methods. You Pay securely via the Shopify payment gateway (SSL encrypted). We do not charge your payment card until the order is accepted and confirmed.
Delivery and Shipping
Newbear ships primarily within the Netherlands, and we also ship internationally to Belgium, France, Spain and Germany. Standard shipping cost is €6,95 per order – any international shipping charges are displayed at checkout.
- Delivery Time: For orders within the Netherlands placed before 23:59 CET on a working day, we aim for next-working-day delivery. Delays can always occur. For other orders (including Belgium and Germany), delivery typically takes 2-3 business days. In all cases, we commit to deliver within the agreed period or – at most – within 30 days of your order. We use the tracking information from the delivery service.
- Late Delivery: If we fail to deliver the goods by the promised date (and no new date is agreed), you may cancel the order and receive a full refund of all payments made.
- Risk of Loss: We bear the risk of loss or damage to the goods during transport until delivery is completed. Once you receive the package, the risk passes to you.
You will receive tracking information by email once your order ships. If you choose a specific carrier or delivery option at checkout, the risk during transit shifts to that carrier once the goods leave our warehouse.
Right of Withdrawal (Return Period)
As a consumer, you have a statutory right to cancel your purchase within 14 days after receiving the goods, without needing to give any reason. This is the EU “cooling-off” period. The 14-day period starts on the day after you (or a third party you nominate, other than the carrier) take physical possession of the goods.
To exercise the right of withdrawal, you must notify Newbear of your decision to cancel within the 14-day period (by emailing service@newbear.nl). We will then give you instructions for returning the items. After notifying us, you still must return the products within the 14 day-period.
Returns and Refunds
Returned goods must be:
- unused;
- in original condition;
- with all tags and packaging intact.
We will charge extra costs if this is not the case.
We may require proof of purchase. To return an item, please email service@newbear.nl and include your order number. We will then send you a return authorization and instructions.
- Return Costs: Unless the goods are defective or incorrect, you are responsible for paying the cost of return shipping. We recommend using a trackable shipping service and insuring the package. Return shipments are at your risk until we receive them. We do not provide pre-paid return labels in general.
- Defective Goods: If the item is damaged, defective or materially not as described, Newbear will cover reasonable return shipping costs. In that case, please contact service@newbear.nl immediately so we can assist.
- Refunds: Once we receive and inspect the returned goods, we will process your refund without undue delay (and no later than 14 days after your notification of withdrawal). Refunds will be made via the original payment method. We will refund the product price and any standard delivery charges you paid – the original outbound shipping cost will be refunded only if the entire order is returned. Please allow up to 14 days for the credit to appear on your account after we approve the return.
- Exchanges and Store Credit: At your request, we can arrange an exchange (subject to availability) or issue store credit instead of a refund. If you prefer one of these options, please indicate this when you contact us for the return. Exchange items are subject to current stock; if the desired item is unavailable, we will issue a refund or store credit.
Liability
Beyond the statutory guarantee, our liability for damages is limited to direct loss up to the amount paid for the product. We are not liable for indirect, consequential or unforeseeable damages (to the extent permitted by law). We also disclaim liability for issues caused by improper use, neglect, normal wear and tear, or events outside our reasonable control. If you have any complaints, please email service@newbear.nl and we will see what we can do for you.
Newbear is not liable for delays or failures to perform our obligations (including delivery) if such delay or failure is caused by events beyond our control. This includes, but is not limited to, strikes or delays by carriers, natural disasters, pandemics, customs delays, or any governmental actions. In such cases we will make reasonable efforts to fulfil the order as soon as possible or to provide an alternative solution.
Personal Data and Cookies
When you shop with us, you provide personal data (name, address, email, payment details). We collect and process only the personal data necessary to fulfill your order. We comply with the EU General Daa Protection Regulation (GDPR). For more details, please see our Privacy Policy. We use cookies on our website to improve your experience; by using our site, you consent to this.
Complaints and Dispute Resolution
We strive to solve any issues promptly. If you have a complaint about your order or product, please contact us at service@newbear.nl. We will address your concerns in accordance with Dutch law.
Governing Law and Jurisdiction
These Terms are governed by Dutch law (which implements EU consumer protection rules). For consumers residing in the EU, mandatory consumer rights of your country also apply and cannot be waived. Disputes arising from these Terms shall be submitted to the competent court in the Netherlands, unless other jurisdiction is required by mandatory local law.
By confirming your order, you acknowledge that you are at least 18 years old (or have parental consent) and have read and agreed to these Terms and Conditions.
Key points
You have 14 days after delivery to cancel (EU law). We aim for fast delivery (order before 23:59, next-day in NL). Shipping is €6,95 per order. We accept all major payment methods (see above). Since Newbear has no physical storefront, all support is via email at service@newbear.nl.
